Terms of Use
1. Accepting these terms
These Terms of Use govern your reading and use of hayracetravel.com, the website of the Hayrace Travel gazette. By opening the site, reading its pages, or writing to its addresses, you agree to these terms in full. If you do not agree with them, the honest course is simply not to use the site. The Privacy Policy, the Cookie Policy, and the Disclaimer sit alongside these terms and apply to the same use. In this document, the company means Hayrace Media LLC, the publisher, and you means the person reading or using the site. These terms were last revised on the date shown at the top of this page, and they apply to every visit, whether you arrive at the front page or step straight into an article.
2. What this site is, and what it is not
Hayrace Travel is an independent gazette about small journeys made on foot, published by Hayrace Media LLC, a registered Rhode Island Limited Liability Company. The site publishes walking routes, essays about transit places, and related notes, all as journalism. It is not a travel agency, a tour operator, a ticket seller, or a booking service of any kind. The site sells nothing, processes no payments, and holds no affiliation with airlines, railways, ferry operators, or booking platforms. Articles describe streets, schedules, and places as the editor found them on the day of walking. Conditions change, and the site's Disclaimer explains how to treat that fact when you plan your own outing. If you need fares, seats, or lodging, those arrangements belong with the operators and services that actually provide them.
3. Using the site properly
You are welcome to read the site, print articles for your own walks, and share the address of any page with others. Use of the site must stay lawful and considerate of the small operation behind it. You agree not to disrupt or overload the site, probe its systems, or interfere with its operation. You agree not to misrepresent any connection between yourself and the gazette, or to present its pages inside another service in a way that hides their source. You agree not to harvest email addresses or other details from the site, and not to use its addresses for bulk or automated mailing. The contact form is for genuine letters, and the company may decline to answer messages that plainly are not. Put simply, read generously, quote fairly, and leave the machinery alone, and this section will not trouble you.
4. Letters and reader contributions
Letters, contact form messages, and route suggestions are welcome, and they remain your own writing. By sending one, you give the company permission to keep it, read it, and act on it, as the Privacy Policy describes. If the gazette wishes to quote a letter in print, it will ask first and will name you only with your agreement. Corrections differ in one small way: the fact of a change on the ground may be verified and used without naming its sender. Please send only material that is yours to send, and leave out other people's personal details unless they have agreed. The company is under no obligation to publish, answer, or return unsolicited material, though in practice most letters receive a reply. Nothing in this section transfers ownership of your words; it simply lets a small paper handle its mail without a lawyer at each elbow.
5. Ownership of the writing and the engravings
Everything published on this site, including the articles, the engraved illustrations, the clock roundel logo, the page designs, and The Timetable newsletter, is the property of Hayrace Media LLC unless a page states otherwise. The names Hayrace Travel and The Timetable identify this publication and may not be used in ways that suggest another origin. You may quote short passages with clear attribution to Hayrace Travel, in reviews, club newsletters, classrooms, and similar settings. Any further reproduction, republication, or public display of articles or engravings requires the company's written permission first. Automated scraping, bulk downloading, and text or data mining of the site are not permitted. Using any part of the site to train machine learning or artificial intelligence systems is likewise not permitted without a written agreement. Facts and place names belong to everyone; the writing and the pictures belong to the company.
6. Copyright concerns
The gazette works hard to publish only original writing and original engravings. If you believe something on this site infringes a copyright you own or represent, please send a notice to postbox@hayracetravel.com, or by post to Hayrace Media LLC, 50 Kennedy Plaza, Providence, RI 02903, United States. A useful notice includes your name and contact details, identification of the work you believe was copied, the exact address of the page on this site, and a description of the claimed copying. Please add a statement that you hold a good faith belief the use is unauthorized, a statement that your notice is accurate, confirmation that you are the owner or authorized to act, and your signature (typed is fine). The company will review the matter and reply within 10 business days. Notices sent without complete details will still be read, and the reply will say what is missing. Depending on what the review finds, the company may remove the material, revise it, or explain why it stands.
7. Mentions of other places and services
Articles name real streets, parks, stations, landings, and, in general terms, the public carriers that serve them. Every such mention is editorial observation, made because the place belongs to the route, and none of it is an endorsement. The company accepts no payment or favor in exchange for editorial mentions. Third parties named or described on the site do not sponsor it and have not approved its contents. If clearly labeled advertising is ever introduced, it would be marked apart from editorial text so the two could not be confused. Until that day, every word on the site is here for readerly reasons alone. Readers who notice a mention that has aged badly are welcome to say so through the contact page.
8. No warranties
The site and everything on it are provided as is and as available. The company does not warrant that descriptions remain accurate after the day of walking, that schedules and stops stay where articles found them, or that access to the site will be uninterrupted or free of faults. Walking conditions, closures, and services change without notice, and printed pages cannot keep pace with every fence and detour. Corrections are made when the gazette learns of changes, but no promise attaches to their timing or completeness. The engravings are artistic renderings rather than surveys, and they should not be read as precise depictions of any place. To the extent the law permits, all implied warranties, including fitness for a particular purpose, are disclaimed. Your own eyes on the day of the walk remain the only current source.
9. Limits on liability
To the fullest extent the law allows, the company, its members, and its editor are not liable for indirect, incidental, consequential, exemplary, or punitive damages arising from the site or its contents. That includes, without limitation, a walk cut short by a closure, a missed connection, a rearranged day, or a trip called off after reading an article. It also includes losses tied to faults in the site itself, such as interrupted access or an error in a page. The company's total liability for any claim will not exceed what you paid to use the site, which is nothing. Reading the site costs nothing, and if you become dissatisfied with it, the remedy is to stop using it. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing in these terms limits liability that the law does not allow to be limited.
10. Your responsibility to the company
If your breach of these terms, or your misuse of the site, brings a claim, demand, or expense against the company, you agree to indemnify and hold harmless Hayrace Media LLC, its members, and its editor. That responsibility covers reasonable legal costs connected with such a claim. The company will let you know of any such matter within a reasonable time and may choose to handle its own defense. This section is not aimed at readers who quote fairly, write letters, and walk the routes; it exists for the rare case of genuine misuse.
11. Governing law and where disputes go
These terms, and any dispute about the site, are governed by the laws of the State of Rhode Island, without regard to its conflict of law rules. Any dispute that reaches a court will be heard in the state or federal courts located in Providence County, Rhode Island. Both you and the company consent to the jurisdiction of those courts and agree that venue there is proper. Before any filing, the company would far rather receive a letter, since most disagreements about a small gazette can be settled by one. The company likewise agrees to write before it files, because paper costs less than any courtroom. Nothing in this section prevents either side from seeking a remedy that the law reserves to other forums.
12. Changes to these terms
The company may revise these terms as the gazette develops or as the law requires. The date at the top of this page records the latest revision, and material changes will be noted plainly on this page. Continuing to use the site after a revision takes effect means the revised terms apply to that use. A revision does not reach back: the version in force when you used the site is the one that governed that use. If a change is unwelcome to you, stopping use of the site is the way to decline it. Checking this page now and then, perhaps when a season turns, is enough to stay current.
13. Housekeeping provisions
If any part of these terms proves unenforceable, the rest continues in force, and the failing part is read as narrowly as needed. A delay in enforcing any provision is not a waiver of it. Section headings exist for convenience and do not change the meaning of the text beneath them. These terms, together with the policies they name, are the entire agreement between you and the company about use of the site. The company may assign these terms to a successor that continues the publication; your rights under them are personal to you and may not be assigned. Rights and duties that by their nature should outlive these terms, such as ownership and the limits above, survive any end of use.
